JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 17.03.2016 in a case registered for the offences punishable under Sections 8, 20(A)(i) and 29 of the NDPS Act.
From the house of the petitioner, 500 grams of ganja were recovered.
It is submitted by learned counsel for the petitioner that small quantity of recovery has been made from the joint family house of the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Learned APP does not dispute the quantum of recovery. Considering the recovery of contraband being small quantity, let the above named petitioner be released on bail, on
Patna High Court Cr.Misc. No.23966 of 2016 (2) dt.30-05-2016 2/2 furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Nalanda in connection with Hilsa P.S. Case No. 133 of 2016.
