Petitioner apprehends arrest in connection with Samastipur Mufassil P.S. Case No. 334 of 2020 registered for the offences under Sections 302, 307 and other allied Sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the petitioner was not present at the time of alleged occurrence and has no concern with the deceased. Petitioner has no criminal antecedent. Learned Additional Public Prosecutor appearing for the State opposes the prayer of bail and submits that there is

No.44559 of 2022(5) dt.27-03-2023 2/2 specific allegation on the petitioner of giving iron rod blow on the head of the deceased namely Birju Ram and the informant which is also corroborated by the Post Mortem Report. He therefore, submits that petitioner does not deserve to be enlarged on anticipatory bail.

Considering the nature of allegation levelled against the petitioner and the submissions advanced on behalf of the parties, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for bail is accordingly rejected.
