The petitioners apprehend their arrest in connection with Ara Town P.S. Case No. 585 of 2020 for the offence registered under Sections 406 and 34 of the Indian Penal Code. The allegation in the FIR is that the accused persons requested the informant to provide his vehicle for the treatment of his mother. When he sent the vehicle along with his driver, these petitioners drove the car to the informant's house and dropped the driver stating that after the treatment of the lady, the car will be returned. Thereafter, despite best of the efforts and request, the accused persons chose not to return the car.

No.46574 of 2022(2) dt.03-01-2023 2/2 Taking into account the fact that there is direct allegation against the petitioners that they were the persons, who dropped the driver and drove the car and thereafter, the car never returned to the original owner, this Court is not inclined to grant them the privilege of bail and the same is accordingly rejected.
