2. The petitioner is in custody since 29.01.2016 in connection with Harnaut P.S. Case No. 402 of 2015 for the offences alleged under Sections 25(1-b)a/26 Arms Act.

3. It is submitted that the petitioner has been falsely implicated under mis-impression that the petitioner was indulging in similar offence while on bail in Harnaut P.S. Case No. 145 of 2005, whereas he had in fact already been acquitted in the said case by judgment dated 11.05.2011. The recovery of the offending articles has not been made from the person of the petitioner rather from the joint house.

4. Having regard to the entirety of the facts and
