25-03-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Koransarai P.S. Case No. 29 of 2016, registered for the offence under Sections 302, 307, 326/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, this petitioner is alleged to have caused gun shot injury to the informant. It is submitted on behalf of petitioner that petitioner has committed no offence and has been falsely implicated in this case due to village politics and old enmity between the parties. It is further submitted that deceased was also a veteran criminal and he might have been killed by some other person and petitioner is in custody since 01.06.2020.

However, learned A.P.P. for the State vehemently

Patna High Court CR. MISC. No.40506 of 2020(3) dt.25-03-2021 2/2 opposed the bail application and submitted that there is direct allegation against this petitioner of causing gun shot injury to the informant on his ribs, which has been found to be grievous in nature by the doctor.

Considering the aforesaid facts and circumstances, the bail application of petitioner is rejected.
