The petitioner seeks bail in a case registered under Sections 376, 313, 506 of the Indian Penal Code. Allegation against the petitioner is that on the false prtext of marriage, the petitioner established physical relationship with the victim-informant. The victim-informant was got twice aborted by the accused petitioner and ultimately, the petitioner refused to marry with the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 12-02-2019. Charge sheet has already been submitted. The petitioner has been falsely

It is alleged that on the false pretext of marriage, the petitioner established physical relationship with the victim-informant. There is no medical report in support of offence under Section-313 of the Indian Penal Code.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria in connection with Mahila P.S. Case No. 13 of 2019.
