JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Petitioner being husband of the informant is languishing in custody since 08.04.2016 in a case registered for the offences punishable under Sections 498A, 323/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioner that admits his marriage with the informant and ready to keep the informant with dignity and honour. Moreover similar was the stand of the petitioner before learned Court below but the informant refused to accept the offer of the petitioner and alleged that petitioner has performed second marriage but petitioner has not performed second marriage. A

Patna High Court Cr.Misc. No.23913 of 2016 (2) dt.26-05-2016 2/2 statement to that effect has been made in para 10 of the petition.

Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nalanda at Biharsharif in connection with Nalanda(Mahila) P.S. Case No. 40 of 2016.
