The petitioner has prayed for bail in a case registered for the offence punishable under sections 406, 420/34 of the Indian Penal Code.

As per allegation in the FIR, petitioner had taken Rs. 2,00,000/- in respect of a land bearing Khata No. 1315 measuring an area of 3.94 decimal. He executed an agreement for sale . When the deed for registration was ready at Registry Office, Purnia, petitioner without putting his signature on the deed, stealthy fled away and in spite of several requests for registration, he refused to execute the sale deed. It is further alleged that he threatened the informant of dire consequences. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.44310 of 2022(5) dt.16-02-2023 2/2 that petitioner has been falsely implicated in this case. There is no documentary evidence against the petitioner. He is a public servant and has committed no offence. It is a case of civil nature. Petitioner is languishing in judicial custody since 24.06.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnia in connection with K. Hat (Madhubani) P.S. Case No. 973 of 2021.
