2. The petitioner seeks bail in connection with Chakrabandha P.S. Case No. 6 of 2025 registered for the offence under Sections 103(1), 61(2), 3(5) of the BNS and under Section 27 of the Arms Act.

3. As per the prosecution case, the deceased was having some dispute with one Akhilesh Singh Bhokta and Akhilesh Singh Bhokta and the petitioner, who is the brother-inlaw of the brother of the Akhilesh Singh Bhokta, are said to have fired upon the deceased.

4. The petitioner is in custody since 13.03.2026.

5. Learned senior counsel for the petitioner submits that the occurrence has taken place on 23.04.2025 but the FIR has been filed on 26.04.2025 and from the post-mortem report, it appears that there is only one gun shot injury sustained by the deceased.

6. Considering the aforesaid facts, it appears that Akhilesh Singh Bhokta has all the reasons for killing the deceased and the petitioner may have falsely been implicated in this case.

7. Accordingly, this application is allowed and the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with Chakarbandha P.S. Case No. 06 of 2025.

8. As a condition of this order, the petitioner, after being released on bail, is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

9. It is made clear that this order will not entitle Akhilesh Singh Bhokta to claim parity with the present petitioner.
