JUSTICE PARTHA SARTHY ORAL ORDER 12-04-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Ujiyarpur P.S. Case no. 116 of 2020 registered under sections 363, 366, 366A and 34 of the Indian Penal Code.

As per allegation in the F.I.R., it is submitted by the informant that the six named accused persons including the petitioner herein took away his minor daughter with the intention of marriage etc.

It is submitted by learned counsel for the petitioner that the allegation as levelled in the F.I.R. are false and concocted. Further from perusal of the F.I.R. itself it would transpire that the daughter of the informant was in regular touch

Patna High Court CR. MISC. No.41024 of 2020(4) dt.12-04-2021 2/2 with different persons on seven different mobile phone numbers. The petitioner has no criminal antecedent and is in custody since 4.5.2020.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the direct allegation of rape against the petitioner which is supported by the victim in her statement under section 164 Cr.P.C., this Court is not inclined to enlarge the petitioner on bail and the same is rejected.
