The petitioner is in custody since 01.03.2016 in connection with a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned Senior Counsel appearing on behalf of the petitioner submits that the petitioner has been made a victim of circumstance only on suspicion as she had asked the victim lady to accompany her in an Auto which was owned by a relative of the petitioner. It is further submitted that the assailant had fired on the petitioner which had hit her thumb and her finger had blown off. It is also submitted that the petitioner may be extended the privilege of bail as she has no criminal antecedent.

No.24390 of 2016 (2) dt.02-06-2016 P2/2 Considering the entire facts and circumstances and the nature of allegations made which is purely based on suspicion, let the petitioner abovenamed be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Rasalpur) P.S. Case No. 59/2016.
