JUSTICE ARUN KUMAR ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Goraul (Katahara O.P.) P.S. Case No.209 of 2013 registered under Sections 147, 148, 323, 324, 354, 447, 379, 427 and 504 of the Indian Penal Code.
Allegation in brief is that all accused persons including female members went over the disputed land and alleged to have assaulted the informant's side. The specific allegation against the petitioner is that he exhorted other accused for assault and said to have removed the Sari of the informant. Learned counsel appearing on behalf of the petitioner submits that the petitioner is old man and there is bonafide land dispute between both side and allegation of outraging modesty is

As in the presence of female members of the petitioner's side, this is absurd and except one case in which the petitioner is on bail and there is no other criminal antecedent. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Taj Mohammad be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul (Katahara O.P.) P.S. Case No.209 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
