JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-01-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 164 of 2016 for the offences punishable under sections 147, 148, 149, 341, 323, 337, 307 and 504 of the I.P.C, later on section 302 I.P.C. has been added.

Allegedly, the petitioner and other five FIR named accused persons came and started abusing and assaulting with lathi, danda, brick and stone and Shambhu Ram assaulted with lathi to the father of the informant causing injury on the head and when he fell down all assaulted with brick and stone causing serious injury to him and further the brother Nandji was also assaulted.

Patna High Court Cr.Misc. No.900 of 2017 (2) dt.12-01-2017 2/2 Submission is of false implication and that against the petitioner there is no specific allegation, he was only member of the mob, specific allegation is against Shambhu Ram and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes.

In the facts and circumstances as stated above, considering that against the petitioner there is no specific allegation and as such the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M-XV, Bhojpur at Ara in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
