The petitioner apprehends his arrest in connection with Imamganj P.S. case No. 181 of 2016 instituted under Section 7 of the Essential Commodities Act.

The allegation, in brief, is that the rice, wheat and Kerosene Oil of the P.D.S shop of the petitioner was to be sold in black market which was apprehended by the supply officials. It is submitted that only 2.32 quintals of wheat, 7.23 quintals of rice and 84.40 litres of Kerosene Oil was found short according to the stock register and that was not updated in the sale register however there is no complain from any card holder against the petitioner and petitioner is a lady suffering from

Patna High Court Cr.Misc. No.3248 of 2017 (3) dt.07-02-2017 2/2 cancer, she had only kept food grain out of her shop for cleaning the shop but it was suspected that it was being moved away. Considering the aforesaid facts and circumstances of the case, let the petitioner, namely, Bimla Devi in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Gaya in connection with Imamganj P.S. case No. 181 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
