The petitioner apprehends his arrest in connection with Dagarua P.S. Case No. 15 of 2019, registered under Sections 341, 323, 353 and 504 of the Indian Penal Code. The accusation is that on Plot No. 1567 in village Kanharia, which is Gairmajura land of Government of Bihar, some land was demarcated by the Circle Amin for construction of Anganwari Centre. On 24.01.2019, when Upendra Kumar, Junior Engineer, MNREGA, reached there for layout then this petitioner made obstruction and started to abuse and assault to him.

Learned counsel for the petitioner submits that, in

Patna High Court CR. MISC. No.43195 of 2019(2) dt.15-07-2019 2/2 fact, due to making complaint by the petitioner to stop the construction work leaving the road situated inside the land in dispute, the present case has been lodged with false allegation and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Purnea, in connection with Dagarua P.S. Case No. 15 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
