JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2019 This application has been filed for modification of the order dated 25.4.2019 passed in Cr.Misc.No.10082 of 2019 by which anticipatory bail application of the petitioner was disposed of with direction to the petitioner to take his wife from her house and appear before the court below on 9.5.2019 but it appears that the same has not been complied.

Submission of learned counsel for the petitioner is that he had gone to the house of opposite party No.2 but she did not agree to accompany him and as such the order could not be complied with, whereas from the order it appears that in the Court learned counsel for opposite party No.2 also stated that

Patna High Court CR. MISC. No.56176 of 2019(2) dt.04-09-2019 2/2 she was ready to reside with the petitioner.

Heard learned APP also.

In the above facts and circumstances, I am not inclined to interfere with the earlier order passed by this order. Accordingly, this application is dismissed.

However, it is made clear that if petitioner appears in the court below along with his wife and pray for regular bail, learned court below shall consider the same after making an inquiry from the opposite party No.2.

With the above observation, this application is disposed of.
