The petitioner seeks bail in connection with Bahera P. S. Case No. 120 of 2016 registered for the offences punishable under Sections 20, 21 and 22 of the Narcotic Drugs and Psychotropic Substances Act.
Regard being had to the recovery of 500 gram of ganja from the possession of the petitioner, who is in custody since 01.05.2016, I am not inclined to grant him bail for the present. Accordingly, the application for bail is rejected. The court below is directed to frame the charges immediately on receipt of the police report. In case, the trial is not concluded within six months from the date of framing of
Patna High Court Cr.Misc. No.24945 of 2016 (2) dt.07-06-2016 2/2 charges, the petitioner would be at liberty to renew his prayer for bail before the court below itself.
