The petitioner apprehends his arrest in connection with Jandaha P.S. Case No.100 of 2021 registered for offences under Sections 147, 148, 149, 307, 323, 325, 337, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
Ten named and two hundred unknown persons are said to have assaulted the prosecution side with bricks etc. and two persons were shot and they have sustained bullet injuries though injuries are said to have been found to be simple. It has been submitted by learned counsel for the petitioner that the petitioner is innocent and he is physically handicapped and in support of the same, he has produced
Patna High Court CR. MISC. No.54538 of 2021(2) dt.27-04-2022 2/2 medical certificate granted by the Civil Surgeon, Samastipur. Considering the fact that the petitioner is physically handicapped and as such he is not expected to participate in such crime, his application for anticipatory bail is allowed. Accordingly, let petitioner, above-named, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. Case No.100 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
