The appellants seek pre-arrest bail in connection with Wajirganj P.S. Case No.387 of 2020 registered under Sections 143, 341, 323, 324, 354, 504 and 506 of the Indian Penal Code and Section 3(1)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Learned counsel for the appellants submits that the appellants have falsely been implicated in the present case.

Patna High Court CR. APP (SJ) No.3944 of 2021(2) dt.25-10-2021 2/2 There is a case and counter case between the parties. The appellants have got no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named appellants be released on bail, in the event of arrest or surrender, on furnishing personal bonds to the satisfaction of learned Exclusive Special Judge, SC/ST Act, Gaya in connection with Wajirganj P.S. Case No.387 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Accordingly, the appeal is allowed and the impugned order dated 08.06.2021 passed in A.B.P. No.1267 of 2021/46 of 2021 is set aside.
