The petitioners apprehend their arrest in connection with Roh P.S. Case No. 65 of 2016 registered under Section 47(a) Bihar Excise (Amendment) Act, 2016.

The learned counsel for the petitioners has submitted that nothing has been recovered from the conscious possession of the petitioners. Co-accused Gopal Prasad who was apprehended on the spot with 14.5 litres foreign liquor, has disclosed the name of the petitioners. He has further submitted that petitioners have no criminal antecedent.

Having considering the facts and circumstances of the

No.4612 of 2017 (2) dt.17-03-2017 case and nothing has been recovered from the conscious possession of the petitioners, let the petitioners, above named, in the event of their arrest or surrender by him within six weeks, be enlarged on bail on his furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Nawada in connection withRoh P.S. Case No. 65 of 2016 subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) sushma/- U
