2. The petitioner seeks regular bail in connection with Pirpainti P.S. Case No. 46 of 2022, registered for the offences punishable under Sections 147, 149, 341, 323, 504, 506, 307 and 302 of the Indian Penal Code.

3. It is alleged that this petitioner along with other FIR named accused persons caused death of father of the informant by inflicting grievous injuries.

4. It is submitted on behalf of the petitioner that the petitioner has been falsely implicated in the present case due to money dispute. It is further submitted that FIR was lodged after an inordinate delay of four days and there is no valid

Specific allegation of assault is against the co-accused, namely, Santosh Mandal, who is alleged to have assaulted on head of the deceased. Doctor has also found only one injury on head of the deceased during postmortem. Petitioner is in custody since 22.08.2023.

5. Learned A.P.P. for the State vehemently opposed the prayer of bail of the petitioner.

In the facts of the case, let the petitioner as named above be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge XI, Bhagalpur, I/C in connection with Sessions Trial No. 52/2024 arising out of Pirpainti Police Station Case No. 46 of 2023.
