JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-06-2021 Heard Mr. Mukesh Kumar Singh, the learned Advocate for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of her arrest in connection with Kuchaikot P.S. Case No. 44 of 2020, dated 11.02.2020, instituted for the offences under Sections 304(B) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The petitioner is the mother-in-law of the deceased. The husband of the deceased is in custody. It has been submitted on behalf of the petitioner that no specific accusation has been levelled against her and
Patna High Court CR. MISC. No.771 of 2021(2) dt.24-06-2021 2/2 that the deceased actually committed suicide. The reason for her committing suicide was her unhappiness with her husband, who, according to her expectations, was not a good match for her.
Regard being had to the facts afore-stated, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Chief Judicial Magistrate, Gopalganj, in connection with Kuchaikot P.S. Case No. 44 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
