The petitioner seeks bail in Ekma P.S. Case No. 177 of 2021, registered for the offence under Section 395 of the Indian Penal Code.

As per the F.I.R., 8-9 miscreants on the point of pistol looted cash of Rs. 17,56,299/- from the informant and fled away.

It is submitted on behalf of petitioner that name of the petitioner transpired during course of investigation and it has come that cash of Rs. 3,60,000/- and one mobile phone have been recovered from the house of the petitioner. It is submitted that though, aforesaid cash has been recovered from the house of petitioner, but till date, neither same has been put on T.I.P. nor identified by the informant. No looted article has been recovered

Patna High Court CR. MISC. No.54942 of 2021(3) dt.07-02-2022 2/2 from the possession of the petitioner. Some of the similarly situated co-accused persons have already been granted bail by this Court. Petitioner is in custody since 25.05.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Saran at Chapra in connection with Ekma P.S.
