JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2017 The petitioner is apprehending his arrest in connection with Supaul P.S. Case No. 293 of 2015 registered for offences punishable under sections 406, 409, 467, 468, 471, 420 and 120B of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner had earlier moved before this Court and this Court, vide order dated 19.12.2016 passed in Cr. Misc. No. 49647 of 2016, rejected the prayer for bail of the petitioner, but in the order sheet it has been mentioned that his name transpired on the basis of confessional statement of co-accused, who had been identified after verification of the C.C.T.V. footage. He further submits that the petitioner has no concern with the aforesaid incident and has falsely been implicated in this case only on account of the fact that

It appears that due to some mistake, the aforesaid fact came in the order sheet, but allegation in this case is that Rs.8,60,000/- and odd had been withdrawn and the petitioner is the Head Clerk of the concerned Office, as such, he may surrender before the court below and make prayer for regular bail, which will be considered by the court below on its own merit considering the material available on record against the petitioner. With the above observation/direction, this petition is disposed of.
