The petitioner seeks bail in a case instituted for the offences under Sections 392 and 307 of the Indian Penal Code and 27 of the Arms Act Prosecution allegation, in short, is that Rs. 25000/- of the informant was looted by unknown accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.4.2019 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has transpired merely on the basis of suspicion. Rs. 800/- and one motorcycle
Patna High Court CR. MISC. No.41729 of 2019(2) dt.08-07-2019 2/2 is alleged to have been recovered. The petitioner had no knowledge that motorcycle in question is a stolen property and as far as money is concerned, the same belongs to him. The recovered money has not been put on TIP.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 419/19.
