JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-03-2017 The petitioner is apprehending his arrest in connection with Complaint Case No. 151C of 2016, registered for offences punishable under Sections 379 and 498A of Indian Penal Code. It has been submitted on behalf of the petitioner that he is husband of opposite party no. 2 and he is still ready to keep his wife (opposite party no. 2) with full honour and dignity and in this case only general and omnibus allegation has been levelled against the petitioner.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact there is allegation against the petitioner of demand of dowry and torture for non fulfillment of the said demand and so far the submission of
Patna High Court Cr.Misc. No.7491 of 2017 (3) dt.17-03-2017 2/2 learned counsel for the petitioner that he is ready to keep the opposite party no. 2 with full honour and dignity, however no such plea has been taken by the petitioner before the court below, as such, I am not inclined to grant the petitioner the privilege of anticipator bail, it is accordingly rejected. The petitioner may surrender before the court below and pray for regular bail and if any such application is filed, the same will be considered by the court below on the merit of the case, without being prejudiced by the order of this Court.
