JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-10-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

Prayer for bail of this petitioner was earlier rejected by this court vide order dated 22.06.2021 passed in Cr. Misc. No. 5107/2021. Through this petition this petitioner has renewed his prayer for bail on the ground that petitioner is patient of Hernia, which has now become dangerous and petitioner has been referred to PMCH for surgery but from perusal of Annexure-3, it appears that petitioner has already been granted permission for test and treatment of his ailment vide memo No. 3214 dated 16.08.2021 by the Superintendent,

Patna High Court CR. MISC. No.54236 of 2021(2) dt.06-10-2021 2/2 Central Jail, Buxar.

Considering the facts aforesaid and nature of accusation against this petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is again rejected. (Prabhat Kumar Singh, J) BKS/- U T
