JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-06-2021 Heard Mr. Prabhat Kumar Singh, the learned Advocate for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Karja P. S. Case No.86 of 2020, instituted for the offences under Sections 272, 273, 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

45 litres of liquor is said to have been recovered from a pick-up van said to have been parked in front of the house of the petitioner. The petitioner has, somehow or the other, been identified as the person who fled away from the van at the time of raid.

The learned counsel for the petitioner has submitted that he has got no concern either with the pick-up van

Patna High Court CR. MISC. No.721 of 2021(2) dt.24-06-2021 2/2 or the seized liquor. He has no criminal antecedents. He further submits that on these facts, no offence under any one of the Sections of the Excise Act is said to have been made against him.

Considering the afore-stated facts, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Muzaffarpur in connection with Karja P. S. Case No. 86 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
