JUSTICE SATYAVRAT VERMA ORAL ORDER 16-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with S.T. Case No. 340 of 2021 (Ishipur (Barahat) P.S. Case No. 73 of 2020, instituted for the offences under Sections 302/201/34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 28.01.2021, he is a person with clean antecedent, charge-sheet has been submitted and petitioner is a woman.

The learned counsel for the petitioner further submits that informant alleges that her two years son was killed by named accused persons including the petitioner on account of land dispute. The learned counsel submits that informant is not

Patna High Court CR. MISC. No.54665 of 2021(2) dt.16-02-2022 2/2 an eye witness to the occurrence, further no benefit would accrue by killing the child to the petitioner. Allegation is based on suspicion as informant had seen the accused person coming from the side where dead body was found.

The learned A.P.P. vehemently opposes the bail application.

Considering the fact that the petitioner is in custody since 28.01.2021, he is a person with clean antecedent, chargesheet has been submitted and she is a woman and the allegation is based on suspicion, the petitioner, above-named, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-X, Bhagalpur, in connection with S.T. Case No. 340 of 2021 (Ishipur (Barahat) P.S. Case No. 73 of 2020.

The application stands allowed.
