Petitioners apprehend their arrest in Forbesganj (Simraha) P.S. Case No.268 of 2019, registered under Sections 448, 341, 323, 325, 324, 307, 379, 504 and 34 of the Indian Penal Code. The informant disclosed in his fardbeyan that his younger brother was quarreling with his wife and in the meantime, many persons belonging to the Sasural of his younger brother came and assaulted the informant and his family members. The informant got bleeding injury on his head and the hand of his mother was broken.

Patna High Court CR. MISC. No.42842 of 2019(2) dt.11-07-2019 2/2 The accused persons are also alleged to have taken away different articles, ornaments and Rs.10,000/- cash.

Learned counsel for the petitioners submits that the petitioners are relatives of the wife of younger brother of the informant. No occurrence as alleged by the informant took place. From perusal of the order of the learned Sessions Judge, it would appear that the injured got simple injuries. No fracture injury was found on the hand of the mother of the informant. Even the informant got simple injury. Petitioners had gone to pacify the quarrel between husband and wife as the informant and his family members were assaulting the wife of younger brother of the informant.

Taking into consideration the facts aforesaid and nature of allegations made against the petitioners, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria in connection with Forbesganj (Simraha) P.S. Case No.268 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) S.
