The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and it is submitted that the petitioner took the vehicle of the informant after paying Rs.50,000/- and rest Rs. Two Lakh was to be paid subsequently. It is next alleged that the petitioner had assured that rest two lakh would be paid after the vehicle is registered in his name, but the petitioner has not paid the said amount, nor is coming forward for getting the vehicle registered.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.44017 of 2022(2) dt.14-12-2022 2/3 without going into the merits of the case, he has instruction to submit that petitioner will pay the rest of the amount within a period of six months from today.

Learned A.P.P. submits that since informant is not appearing how will he come to know that petitioner has agreed before this Court for making payment of the aforesaid amount. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on provisional bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Ara Muffasil P. S. Case No.17 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.

However, the learned trial Court will get this order communicated to the informant through her learned lawyer. Further, if the petitioner does not pay the amount within the period of six months from today as agreed and the informant brings the said fact to the notice of the learned trial Court, the
