JUSTICE SANJAY KUMAR ORAL ORDER 06.02.2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Maker P.S. Case No. 89 of 2016 for the offences instituted under Sections 147, 148, 149, 448, 553, 452, 427, 380, 153(A), 295, 295(A), 436 and 431 of the Indian Penal Code.

The petitioners were identified in a mob of 500 people, who had blocked the road in protest against some indecent photographs of the Hindu Idols.

Allegation is that the petitioners were likely to create a communal disharmony and they obstructed the official to discharge the official duty.

No.5471 of 2017 (2) dt.06-02-2017 2/2 Considering the nature of allegation as well as claims of the petitioners that they are local shopkeepers, and also the fact that other accused having similar allegations have been allowed the privilege of anticipatory bail in Cr.Misc.No.49474 of 2016, let the petitioner above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Maker P.S. Case No. 89 of 2016 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
