1. Heard learned counsel for the petitioners and learned A.P.P. Sri Rabindra Kumar for the State.

2. The learned counsel for the petitioners, after arguing vehemently for sometimes realizing his difficulty, seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.2, namely, Mundrika Mahto @ Mundrika Kushwaha.

3. Permission is accorded.

4. Accordingly, instant petition is dismissed as withdrawn with the liberty aforesaid with respect to petitioner no.2, namely, Mundrika Mahto @ Mundrika Kushwaha.

5. The petitioner no.1 seeks bail in anticipation of his

Patna High Court CR. MISC. No.44551 of 2026(2) dt.27-07-2026 2/3 arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 118(1), 303(2), 352, 351(2) and 3(5) of the B.N.S.

The learned counsel for the petitioner submits that the petitioner no.1 is a person with clean antecedent and the informant alleges that he along with his wife (Meena Devi) and son (Sonu Kumar) at 6.00 A.M. had gone on their land for harvesting the crop, when accused persons including the petitioner came and petitioner assaulted by Axe causing injury on palm, while Mundrika Mahto assaulted by rod causing fracture of right hand, thereafter Ravi Mahto assaulted Sonu by rod, but informant tried to ward of the blow leading to injury on hand. It is next alleged that women family members of Chandrama snatched his chain.

7. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case on account of dispute relating to land. It is further submitted that one of the injuries suffered by the informant has been opined to be grievous in nature, but then allegation of causing fracture of hand of the informant is not against the petitioner.

8. Learned A.P.P. Sri Rabindra Kumar opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner no.1, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with M.H. Nagar P. S. Case No.154 of 2026, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
