The petitioner, husband of Opposite Party No. 2 apprehends his arrest in Banka Mahila P.S. Case No. 73 of 2018 registered for the offence under Section 498(A)/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.

Earlier, vide order dated 20.11.2019, the matter was sent to Mediation Centre of Patna High Court for settlement of dispute between the parties.

Learned counsel for the petitioner submits that the dispute has already been resolved through mediation. The petitioner is ready to keep his wife/O.P. No. 2 with full dignity and honour and this fact is also not disputed by the counsel for

Patna High Court CR. MISC. No.45154 of 2019(5) dt.19-02-2020 2/2 O.P. No. 2.

Considering the fact that dispute has been resolved and the petitioner is ready to keep his wife with full dignity and honour, the petitioner above-named, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka Mahila P.S. Case No. 73 of 2018 on the following conditions:

(i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below.

(ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (Prabhat Kumar Singh, J) vinita/- U T
