JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Mufassil (Lakhaura) P.S. Case No. 125 of 2019 registered for the offences punishable under Sections 366A and 120B of the Indian Penal Code.

Allegation as per FIR is that petitioners got the minor daughter of informant kidnapped and it further appears from the statement of victim girl recorded under Section 164 Cr.P.C. that one Kamlesh Ram and Anita Devi had taken her to Kathmandu for the purpose of marriage.

Submission of learned counsel for the petitioners is that the main allegation is against Kamlesh Ram and Anita Devi and petitioners have falsely been implicated in this case.

Patna High Court CR. MISC. No.41751 of 2019(4) dt.11-09-2019 2/2 Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioners on the ground that victim girl is minor and petitioners have called her in their house and thereafter they handed over her to Kamlesh Ram and Anita Devi.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioners. However, they may surrender and pray for regular bail, which shall be considered on the basis of materials available on the record.

Accordingly, this application is dismissed.
