====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-03-2023 Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in a case registered for the offences punishable under Section 302/34 of Indian Penal Code.
As per prosecution case, petitioner assaulted on the chest of informant's father namely Bali Yadav by means of iron rod and co-accused Shambhu Yadav caught his neck and dashed as a result of which he died.
Learned counsel appearing for the petitioner submits that the prosecution case is falsified by the post-mortem report. Doctor has not found any injury on the body of the deceased. It
Patna High Court CR. MISC. No.44724 of 2022(7) dt.21-03-2023 2/2 is next submitted that allegation of pressing the neck is against co-accused Shambhu Yadav.
However, counsel for the informant vehemently opposes the prayer for bail application and submits that there is specific allegation of causing assault on the chest of the deceased.
Considering the nature of accusation, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
