2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Hamjapur P.S. Case no. 38 of 2025 instituted for the offence under Section 30(a) of the Bihar Prohibition of Excise Act.

3. As per allegation in the FIR, five accused persons were coming from Dharahara with five horses loaded with liquor on each. On seeing the police, they tried to fly but one of them fell down with loaded material from the horse and arrested by the police, who disclosed the name of other four accused persons including the petitioner. On search, total 445

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has got no criminal antecedent. Petitioner has no concern with the alleged recovery. He has been falsely implicated due to previous enmity. The name of the petitioner has been disclosed in this case by co-accused, namely, Ram Kumar who was arrested on spot. Neither the petitioner was arrested nor any incriminating article has been recovered from his possession.

5. Learned APP appearing for the State has opposed the prayer of Bail.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Hemjapur P.S. Case no. 38 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-1 (Excise Act), Munger subject to the conditions as laid down
