2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Mali P.S. Case No. 114 of 2025 instituted for the offence under Sections 191(2), 190, 127(2), 115(2), 109, 132, 253 and 352 of B.N.S., Section 30(a) of the Bihar Prohibition and Excise Act and Section 3(1)(r) (s) and 3(2) (Va) of the SC/ST Act.
3. The case of the prosecution is that the police had secret information that the illegal liquor is being sold and when the police went there, accused started fleeing away. He was being apprehended and from his possession, 2.1 liters of country made liquor was recovered. Apprehended person was identified
Patna High Court CR. MISC. No.46018 of 2025(2) dt.05-08-2025 2/3 as Dhanjaya Soni. It is further alleged that meanwhile villagers gathered started abusing and stone pelting on the police. This petitioner was identified in the videography of CCTV by the local chowkidar.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that on same day, the villagers have given a Protest Petition before S.P. regarding the atrocities of the police. He has further submitted that nothing has been recovered from the possession of this petitioner and there is no specific allegation against him.
5. In contra, learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioner and has submitted that petitioner is having one criminal antecedent of similar nature.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Mali P.S. Case No. 114 of 2025, he

No.46018 of 2025(2) dt.05-08-2025 3/3 will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise 2nd , Aurangabad subject to the conditions as laid down under section 482(2) of B.N.S.S.
