JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2019 Earlier prayer for bail of the petitioner was dismissed twice firstly vide order dated 07.08.2017 passed in Cr. Misc. No. 22401 of 2017 and secondly vide order dated 18.07.2018 passed in Cr. Misc. No. 34988 of 2018 ad petitioner happens to be husband of the deceased and allegation against him is that he caused the death of the deceased. Submission of learned counsel for the petitioner is that the petitioner has been in judicial custody since 27.08.2016 and uptil now only four witnesses have been examined and there is no likelihood of conclusion of trial in near future.

Having heard both sides, considering the facts and

No.47830 of 2019(2) dt.01-08-2019 2/2 circumstances of the case and also the period of incarceration of the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.- II, Sitamarhi, in connection with Sessions Trial No. 399/2011 arising out of Sitamarhi P.S. Case No. 57 of 2009, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
