JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 302/34 of the Indian Penal Code.
Heard learned counsel for the petitioners.
It has been submitted on behalf of the petitioners that except suspicion there is nothing against the petitioners and other similarly situated co-accused has been granted anticipatory bail by the court below itself Heard learned A.P.P. also.
Heard both sides. From perusal of the impugned order it appears that learned court below is of the view that petitioners in conspiracy with others had killed brother of the
Patna High Court Cr.Misc. No.4344 of 2017 (2) dt.13-02-2017 2/2 informant. As such, I am not inclined to grant anticipatory bail to the petitioners, the same is rejected.
However, petitioners are directed to surrender in the court below, i.e., learned A.C.J.M.-VIII, Swan , in connection with Raghunathpur P. S. Case no. 113 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.
