JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2018 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. Petitioner apprehends his arrest in connection with Harsidhi P.S.Case No. 314 of 2016 registered for the offences punishable under Section 420 of the Indian Penal Code and Section 138 of N.I.Act.

Submission of learned counsel for the petitioner is that he has already paid Rs.1.5 lakhs out of total amount of Rs. 7,73.600 and rest amount will be deposited in 12 months. In view of submission, this application is disposed of with a direction to the petitioner to surrender within a period of six weeks from the receipt of this order along with a Bank Draft of

Patna High Court Cr.Misc. No.16942 of 2018 (4) dt.22-06-2018 2/2 Rs.1.3 lakhs in favour of O.P.No.2 and on his so surrendering he will be released on provisional bail for seven months and he will continue to pay the rest of the amount in seven equal instalments in next seven months. Failure to deposit any instalment his bail bond shall be cancelled. It is made clear that the amount deposited be released in favour of opposite party No.2 and the same will be subject to result of the case. Once the total amount is deposited, bail bond of the petitioner shall be confirmed. Opposite party No.2 assured that on depositing whole amount, he will not press the case.

With the above observation, this application is disposed of.
