The Petitioner apprehends his arrest in Sono P.S. Case No.52 of 2016 instituted for the offence under Section(s) 147, 341, 323, 324, 307, 504, 506, 379 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, Jamui.

It has been submitted that there was fight from both sides. The petitioner had no intention to cause grievous injury. The learned APP has submitted that all the witnesses have levelled specific allegation of assault on the head of the informant by this petitioner. The doctor has found injury on his head.

Patna High Court Cr.Misc. No.1595 of 2017 (4) dt.15-02-2017 2/2 As per the written report, the petitioner is alleged to have given a Tangi blow on the head of the informant causing bleeding injury. The doctor has found two sharp cut injuries on his left and right temporal of skull and the x-ray report shows hair-line fracture on vertex of skull. The injury was opined to be grievous in nature.

In view of such, this Court does not find it a fit case for grant of anticipatory bail.

Prayer is rejected.

The petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
