The petitioners moved before this Court for quashing of the cognizance order dated 05.10.2020 passed by the learned I/c Additional Chief Judicial Magistrate, XIIth, Saran at Chapra in Derni P.S. Case No.165 of 2019 (G.r. No.7069 of 2019) under Sections 304(B) and 120(B) of the Indian Penal Code. At the outset, the learned counsel for the petitioners submits that he intends to withdraw the application with a liberty to take up all the points at the time of the framing of charge, if it still has not been framed.

The petitioners are allowed to withdraw the application.
