The petitioner apprehends her arrest in connection with Kaji Mohammadpur P.S. Case No. 128 of 2004 registered under Sections 302, 120(B) and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that there is specific allegation against co-accused Babita Kumari and Ramesh Kumar Thakur. Petitioner is an old woman having age of 71 years and she has got no criminal antecedent. Having considered the facts and circumstances of the

Case No. 128 of 2004, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
