The petitioners apprehend their arrest in Patna Mahila P.S. Case No. 31 of 2016 instituted for the offence under Section 498A/34 of the Indian Penal Code, under Section 3⁄4 D.P. Act and under Section 66D of I.T. Act.
It is alleged that informant was married with Chandan Singh on 04.12.2011. She lived with him in America where he is working in cognizant Company. She was tortured by her husband in U.S.A. The informant returned to India with her husband on 14.05.2016. It is further alleged that on account of torture, her health deteriorated. She has further stated that earlier also her mother-in-law, father-in-law, nanad etc. assaulted her and committed torture.
Patna High Court Cr.Misc. No.1433 of 2017 (2) dt.16-01-2017 2/2 It has been submitted that petitioners are mother-inlaw, father-in-law and Chachera Bhaisur of the informant. It has been submitted by the State that in the written report the informant has alleged that her father-in-law sprinkled kerosene oil and nanad came with matches.
From the impugned order, it appears that nanad has already been granted anticipatory bail by the learned Addl. Sessions Judge-II, Patna, vide A.B.P. No. 4025 of 2016 dated 20.10.2016. There is general allegation against the father-in-law that he sprinkled kerosene oil over the informant. Besides this, there is no any specific allegation against the petitioner nos.2 and
3. In the circumstances, prayer of the petitioners for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Patna Mahila P.S. Case No. 31 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, subject to the conditions as laid down under Section 438(2) Cr.P.C.
