2. The petitioner seeks bail in connection with Varishnagar P.S. Case No. 103 of 2025 registered for the offence under Sections 319(2), 318(2), 338, 336(3), 340(2), 316(2), 111, 61(2) of the BNS.

3. As per the prosecution case, the petitioner and others are said to have cheated the informant.

4. The petitioner is in custody since 10.05.2025 and he claims to have clean antecedent.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent as he is the owner of the CSP Shop which was used for cheating the gullible customers by co-accused Baby Khatoon.

6. Learned counsel for the petitioner submits that the petitioner has not been benefitted from the illegal money.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Chief Judicial Magistrate, Samastipur/concerned Court below in connection with Varishnagar P.S. Case No. 103 of 2025.

9. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other case then the bail bonds of the petitioner shall not be accepted. (Sandeep Kumar, J) Vikas/- U
