The petitioner seeks bail in Alamganj P.S. Case No. 82 of 2021, registered for the offence under Sections 302/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., this petitioner alongwith co-accused Bikki Mobile are alleged to have shot son of the informant. It is submitted on behalf of petitioner that informant is not the eye-witness of the occurrence and only on suspicion, petitioner has been made accused. Petitioner is in custody since 15.03.2021.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is named in the F.I.R. and

No.55893 of 2021(3) dt.29-01-2022 2/2 during course of investigation in paragraph 10 of the case diary, Ganesh Gope, who is eye-witness of the case, has stated that firstly petitioner has shot fire on the deceased, which hit on the face of deceased. It is further submitted by learned A.P.P. that petitioner has got criminal antecedent also and he is accused in four more cases.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is rejected.
