The petitioner seeks bail in connection with Special Excise Case No.2530 of 2021 arising out of Nadi P. S. Case No.67 of 2021, instituted for the offences under Sections 30(a), 37(b)(c) of the Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 30.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 315 litre of liquor from the co-accused and as far as this petitioner is concerned, it is alleged that he was found drunk.

The learned counsel for the petitioner submits that

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 30.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No.2530 of 2021 arising out of Nadi P. S. Case No.67 of 2021.

The application stands allowed.
