Petitioner apprehends arrest in a case registered for the offence punishable under Sections 323, 341, 504 and 498 (A)/ 34 of the IPC read with section 3⁄4 of the Dowry Prohibition Act.

As per the prosecution case, allegation against this petitioner is of commission of torture and harassment due to non-fulfillment of dowry.

Learned counsel appearing for the petitioner denies the prosecution case and submits that the petitioner is husband

Patna High Court CR. MISC. No.44141 of 2022(3) dt.13-12-2022 2/2 of the informant and at no point of time he committed torture and harassment to the informant. The informant is already being paid an amount of Rs. 5000/- per month by the petitioner. Learned counsel appearing for the informant vehemently opposes the prayer for bail.

Considering the same of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 114 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) asmit/- U
