The petitioner seeks anticipatory bail in a case registered for the offence punishable under Sections 420, 406, 467, 468, 504, 506 and 34 of the Indian Penal Code.
The complaint based allegation would reveal that the petitioner is full brother of the complainant. The petitioner, allegedly, took out Rs. 2,50,000/- (two lacs and fifty thousand) from the bank account of the complainant through ATM.
Submission is that just for property dispute, false allegation has been levelled. For withdrawal of money through ATM, knowledge of secret number is essential and the complaint
Patna High Court Cr.Misc. No.22077 of 2018 (4) dt.29-05-2018 petition does not disclose that secret number was known to the petitioner or the same was disclosed to the petitioner. Considering the fact aforesaid, let the petitioner above named, in the event of his arrest or surrender within 30 days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Vaishali P.S. Case No. 310 of 2017, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which, the court below shall be at liberty to cancel the bail bond of the petitioner.
